Having professional protection is essential. This means protection against the potentially harmful costs of litigation, as well as the other challenges you might face throughout your career.
Claims-made protection gives you access to all the benefits of Medical Protection membership - including expert medicolegal advice, support, and a whole range of risk prevention tools and techniques - along with the right to request assistance with claims for damages, costs or compensation arising from adverse clinical incidents.
Retroactive protection
If your previous provider offered protection on a claims-made basis, you can request a retroactive date to your membership which allows you to report matters that relate to your practice prior to joining Medical Protection. This retroactive protection ensures that you have continuous protection for claims which you are currently unaware of that might arise from your clinical practice in previous years.
Extended Reporting Benefit (ERB)
An ERB enables you to report adverse incidents that occurred during your claims made membership, which you only become aware of after your membership has ended. Once reported, you can seek our assistance with any claim arising from such an incident.
An ERB is included if you retire or permanently cease practice due to disability or ill health, subject to a qualifying period of 5 years continuous claims-made membership with Medical Protection.
When we take on a member's case, we can take care of all the legal costs and damages or compensation payments up to a discretionary limit which will be stated in your membership documentation.
This limit applies to all legal costs and compensation payments arising from adverse incidents that are reported in a single membership year. This limit is for:
- one individual adverse incident, or
- the total of all adverse incidents reported in a single membership year.

Reporting an adverse incident
An adverse incident is any event or circumstance that might give rise to you seeking assistance and/or indemnity from us. You must report an adverse incident to us as soon as possible. This should be immediately after it occurs, or when you become aware that it has occurred.
