MPS response to Dr Bawa-Garba appeal news

Commenting on the news that Dr Bawa-Garba’s appeal has been granted -

Dr Rob Hendry, Medical Director at the Medical Protection Society (MPS), said:

“MPS was taking steps to submit an appeal as soon as the High Court judgement was handed down, so we are very pleased the appeal submitted by Dr Bawa-Garba’s new legal team has been granted. It is an important step for Dr Bawa-Garba, but also for the wider profession.

 

“A gross negligence manslaughter (GNM) conviction should not automatically mean that a doctor who has remediated and demonstrated insight into their clinical failings is erased, and it is encouraging that Lord Justice Simon rejects this argument in his reasons for granting the appeal. We have urged Professor Sir Norman Williams to address this crucial point as part of the Government’s rapid review into GNM in healthcare and confirm publically that the GMC will not be granted presumption of erasure powers.”
