Our approach to Notice of Contribution and Indemnity (NCI) Claims

Being named in contribution and indemnity proceedings can be unexpected and complex. If you receive a Notice of Contribution and Indemnity (NCI), Medical Protection will consider your request for assistance and assess the circumstances of the claim on its individual merits. This page explains our approach to supporting members who are named in NCI claims and third-party proceedings.

What is a Notice of Contribution and Indemnity (NCI)?

A Notice of Contribution and Indemnity (NCI) is a legal notice served by one defendant who believes another party should bear some or all of the responsibility for compensation awarded in a claim.

If you receive an NCI, it means that the hospital or another defendant is seeking to hold you responsible for part, or all, of any damages they may have to pay.

How Medical Protection can assist

As a member of Medical Protection, your membership includes assistance with NCI claims and third-party proceedings where you are named as a defendant in a medical negligence claim seeking contribution and indemnity.

Assistance includes acting on your behalf to consider the allegations and determine the extent, if any, of your liability arising from your individual clinical practice.

Where appropriate, indemnity would include meeting any damages and legal costs that relate to your individual liability for the claim.

Individual assessment of claims

We will always consider each case on its merits to ensure we are providing appropriate assistance when the matter falls within the scope of membership. Further information about where we can assist is included in our Statement of Benefits.
