MPS comments on the High Court's decision to implement a Clinical Negligence List

Commenting on the High Court’s decision to implement a dedicated Clinical Negligence List, where the court may issue directions to ensure that all parties have taken the necessary investigative steps before setting a trial date for the claim.

Dr Rob Hendry, Chief Member Officer at Medical Protection Society (MPS), said:

“We are pleased to see the announcement of new court directions which will introduce a dedicated Clinical Negligence List within the High Court personal injuries list.

“MPS has long campaigned for case management of clinical negligence actions, and we believe that this change could be very helpful in reducing the impact of trials being scheduled prematurely and giving those involved the opportunity to resolve claims well before any trial date.

“The human cost of clinical negligence claims to both healthcare professionals and patients needs to be greatly reduced and we urge the Government to also introduce pre-action protocols as a matter of urgency.”
