Last updated 18/05/2020 MPS has responded to the CQC proposal to introduce the Statutory Duty of Candour. MPS fully supports the focus of the Francis Inquiry Report on the need to achieve an open culture in the NHS. However, we have concerns about the draft regulations for a duty of candour: A legal duty of candour is not an effective or appropriate way to provide the impetus needed to change behaviour in the NHS Regulation or legislation will never be able to adequately define, and therefore create, genuine open communication between healthcare professionals The regulations will encourage a bureaucratic, top-down, compliance-driven, blame culture and will undermine a culture of transparency and learning The draft regulations are poorly and inappropriately defined.
