Limitations of the Clinical Indemnity Scheme
The Clinical Indemnity Scheme will provide cover for clinical negligence claims arising from private practice within public hospitals. This will include services provided at hospitals, clinics, other facilities owned or operated by the agency as well as in patients’ homes and other community based facilities.
It will not cover the off-site private practice of Category 1 and Category 2 consultants. It will not cover the work of consultants who work full time in the private sector. As a member you can apply for assistance with the following non-indemnity services which are not included in The Clinical Indemnity Scheme:
- Professional tribunals
- Medicolegal and ethical advice
- Garda investigations (arising from professional practice)
- Disciplinary actions
- Medical Council investigations
- Health Board/Hospital enquiries
- Complaints
- Issues affecting your professional reputation
- 24 hour free phone advisory service
- Good Samaritan acts not covered by enterprise liability
The Clinical Indemnity Scheme will provide representation at coroner’s inquests for agencies and practitioners covered by the scheme. Where a doctor or dentist wishes to be separately represented at an inquest, he/she will be entitled to request his/her defence organisation to provide separate representation.
